VT Supreme Court overturns energy court ruling, says Bennington solar project violates town plan - WCAX

The Vermont Public Utility Commission, the state's "energy court," had to answer to a higher power when the Vermont Supreme Court overturned its approval of a Bennington solar project. Neighbors said the project violated town standards for aesthetics and orderly development, and the Supreme Court agreed. 

"The ruling Friday in the case of the Apple Hill solar project found that the Vermont Public Utility Commission overlooked key elements of the Bennington Town Plan when it granted a Certificate of Public Good for the 2 megawatt farm."
